Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and 360CarMart Pte. Ltd. ("360CarMart", "we", "us", or "our"), a company incorporated in Singapore, governing your access to and use of the 360CarMart website at www.360carmart.com and any related mobile applications, tools, or services (collectively, the "Platform").

By accessing or using the Platform in any way — including browsing listings, creating an account, enquiring about a vehicle, or subscribing as a dealer — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, you must immediately cease all use of the Platform.

You must be at least 18 years of age and legally capable of entering into binding contracts under Singapore law in order to use the Platform. If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

2. Services Provided

360CarMart operates an online vehicle marketplace that connects car buyers with licensed motor dealers and private sellers based in Singapore. Through the Platform, we provide:

• Vehicle Listings: A searchable catalogue of new and used cars listed by approved dealers and, where applicable, private individuals. Listing details are supplied by the respective sellers.
• 3D Interactive Viewing: Where a vehicle has been digitised, Users may explore an interactive 3D model of the exterior and interior as a supplementary inspection aid. 3D viewing is an informational tool only and does not constitute a physical inspection.
• Valuation Estimates: The Platform may present estimated vehicle values or depreciation figures derived from market data. All valuations are indicative estimates only and do not constitute professional appraisals, financial advice, or guaranteed trade-in or purchase prices.
• Enquiry and Lead Routing: Facilities that allow buyers to submit enquiries to dealers regarding specific vehicles. 360CarMart acts solely as a conduit; we are not a party to any transaction between a buyer and a dealer.
• Financing and Insurance Information: General information regarding vehicle financing and insurance products available in Singapore. This does not constitute a financial advisory service regulated under the Financial Advisers Act (Cap. 110).
• COE and Market Data: Publicly sourced data on Certificate of Entitlement (COE) prices and related metrics, provided for informational purposes only.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. User Accounts

3.1 Buyer Accounts

Buyers may register for a free account to access features such as saved searches, enquiry history, and personalised recommendations. You agree to provide accurate, current, and complete information when registering and to keep your account details up to date.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@360carmart.com if you suspect any unauthorised access to your account. 360CarMart shall not be liable for any loss arising from unauthorised use of your credentials.

3.2 Dealer Accounts

Dealer accounts are subject to a separate application and approval process. Applicants must be Authorised Motor Dealers (AMDs) or otherwise licensed to trade motor vehicles in Singapore under the Motor Vehicles (Amendment) Act or equivalent applicable legislation. Approval is at the sole discretion of 360CarMart.

Approved dealers are granted access to the Dealer Portal upon acceptance of the Dealer Agreement, which supplements these Terms. Dealer access is conditional on maintaining an active paid subscription and continued compliance with these Terms, the Dealer Agreement, and all applicable laws.

3.3 Account Termination

360CarMart may suspend or terminate any account at its sole discretion, with or without notice, where it reasonably believes that a User has breached these Terms or where termination is required by law. You may close your account at any time by contacting us. Termination does not affect any rights or liabilities that have accrued prior to the date of termination.

4. Dealer Listings

4.1 Dealer Responsibility for Content

Dealers are solely responsible for the accuracy, completeness, and legality of all listing content submitted to the Platform, including but not limited to vehicle specifications, condition descriptions, pricing, photographs, and registration particulars. Dealers warrant that all listing information complies with the Consumer Protection (Fair Trading) Act (Cap. 52A) and all other applicable Singapore laws and regulations.

360CarMart does not independently verify the accuracy of listing information and makes no representation or warranty as to the condition, title, or suitability of any vehicle advertised on the Platform.

4.2 Removal of Non-Compliant Listings

360CarMart reserves the right, but is not obligated, to review, edit, refuse to publish, or remove any listing at any time where it determines, in its sole discretion, that the listing:

• Violates these Terms or the Dealer Agreement;
• Contains false, misleading, or deceptive information;
• Relates to a vehicle that has been scrapped, deregistered, exported, or otherwise is no longer available for sale;
• Breaches any applicable law or regulatory requirement; or
• Is otherwise contrary to the integrity of the Platform.

Removal of a listing does not entitle a dealer to any refund of subscription fees. Repeated non-compliance may result in suspension or termination of the dealer's account.

4.3 Listing Fees

The right to publish listings on the Platform is subject to an active paid subscription as set out in the Dealer Agreement and the pricing schedule published at /for-dealers. All fees are quoted in Singapore Dollars and are exclusive of applicable taxes unless stated otherwise.

5. Prohibited Conduct

When using the Platform, you agree that you will not, and will not assist or enable any third party to:

• Post, upload, or transmit any content that is false, misleading, fraudulent, defamatory, obscene, or otherwise unlawful;
• Create fictitious or ghost listings for vehicles that do not exist, are not available for sale, or have been materially misrepresented;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Use the Platform to solicit buyers or leads for motor vehicles listed or to be listed on competing platforms without 360CarMart's prior written consent;
• Systematically retrieve data from the Platform by scraping, crawling, spidering, data mining, or any automated means without our express written permission;
• Use the Platform in any manner that could overload, damage, or impair the infrastructure supporting the Platform;
• Circumvent, disable, or interfere with any security, authentication, or access control feature of the Platform;
• Use the Platform to engage in any form of fraud, including payment fraud, identity theft, or money laundering; or
• Violate any applicable local, national, or international law or regulation.

A breach of this clause may result in immediate account suspension, removal of all associated content, and referral to the relevant authorities, including the Singapore Police Force and the Competition and Consumer Commission of Singapore (CCCS).

6. Intellectual Property

6.1 Platform Content

All software, technology, design, text, graphics, logos, icons, user interfaces, and other content forming part of the Platform (excluding User-submitted content) are owned by or licensed to 360CarMart and are protected by copyright, trademark, and other intellectual property laws of Singapore and applicable international conventions. No licence to such intellectual property is granted to you other than the limited right to use the Platform in accordance with these Terms.

The 360CarMart name, logo, and all related marks are trademarks of 360CarMart Pte. Ltd. You may not use any 360CarMart trademark without our prior written consent.

6.2 User-Submitted Content

Dealers and Users may submit content to the Platform, including vehicle photographs, descriptions, and other media ("User Content"). You retain ownership of User Content that you submit; however, by submitting User Content, you grant 360CarMart a worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, adapt, publish, distribute, and display such content in connection with the operation and promotion of the Platform for the duration of these Terms.

Vehicle photographs and media assets uploaded by dealers remain the property of the respective dealer or the photographer who created them. 360CarMart does not claim ownership of dealer-supplied images.

You represent and warrant that you have all necessary rights to submit User Content and that such content does not infringe any third-party intellectual property right or violate any applicable law.

7. Disclaimers

THE PLATFORM AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY SINGAPORE LAW.

Without limiting the foregoing, 360CarMart expressly disclaims:

• Pricing accuracy: Vehicle prices displayed on the Platform are set by dealers and may not reflect current market prices. Prices are subject to change without notice and do not constitute an offer to sell.
• Valuations: Valuation estimates, depreciation projections, and COE-related calculations are indicative only, derived from publicly available data and proprietary models. They are not professional appraisals and should not be relied upon for financial decisions without independent verification.
• Vehicle condition: 360CarMart does not inspect, certify, or guarantee the mechanical condition, accident history, mileage accuracy, or legal status of any vehicle listed on the Platform. Buyers are strongly advised to conduct their own independent inspection and due diligence before entering into any purchase agreement.
• 3D viewing: Interactive 3D models are representational aids only. They may not reflect the vehicle's actual current condition, colour, wear, or any subsequent modifications made after digitisation.
• Third-party links: The Platform may contain links to third-party websites and services. 360CarMart is not responsible for the content, accuracy, or practices of any third-party site.

8. Limitation of Liability

To the maximum extent permitted by applicable Singapore law, 360CarMart, its directors, officers, employees, agents, affiliates, and licensors shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising from your use of or inability to use the Platform;
• Any dispute, claim, or loss arising out of or relating to a transaction or interaction between a buyer and a dealer, including disputes over vehicle condition, pricing, title, or delivery. Such disputes are solely between the buyer and the dealer concerned;
• Any reliance placed on valuation estimates, market data, financing indicatives, or other informational content provided on the Platform; or
• Unauthorised access to or alteration of your transmissions or data.

Notwithstanding the above, where liability cannot be excluded under Singapore law, 360CarMart's aggregate liability to you for all claims arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total subscription fees paid by you to 360CarMart in the three (3) months immediately preceding the event giving rise to the claim, or (b) Singapore Dollars one hundred (S$100).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, to the extent that such exclusion or limitation is not permitted under Singapore law.

9. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

You and 360CarMart agree to submit to the exclusive jurisdiction of the courts of Singapore to resolve any dispute or claim arising out of or in connection with these Terms or the Platform.

Before commencing formal proceedings, the parties agree to attempt in good faith to resolve any dispute through direct negotiation for a period of thirty (30) days from the date on which one party notifies the other of the dispute.

10. Changes to Terms

360CarMart reserves the right to update or modify these Terms at any time. Where we make material changes, we will notify registered Users by email or by posting a prominent notice on the Platform prior to the changes taking effect. The date of the most recent revision is indicated at the top of this page.

Your continued use of the Platform after revised Terms have been posted constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cease using the Platform and, if applicable, close your account.
